Act 2005-66 legislation:
Article I. Declaration of Rights, %A7 21. Right to bear arms:
The right of the citizens to bear arms in defense of
themselves and the State shall not be questioned.
The General Assembly, in 2005, Nov. 10, P.L. 335, No. 66,
effective [May 9, 2006], found and declared:
- The provisions of 23 Pa.C.S. Ch. 61 (relating to
protection from abuse) are necessary and proper in that they
further the Commonwealth's compelling State interest to
protect victims of domestic violence from abuse.
- The Second Amendment to the Constitution of the United
States and section 21 of Article I of the Constitution of
Pennsylvania recognize a fundamental right to keep and bear
arms.
- The limitation of firearm rights for the duration of a
protection from abuse order as authorized by 23 Pa.C.S. Ch.
61 is a reasonable regulation, a valid exercise of the
police power of the Commonwealth and furthers the compelling
State interest to protect victims from abuse.
- As provided in 23 Pa.C.S. Ch. 61, a court may impose
limitations on firearm rights prohibiting someone who has
engaged in domestic violence from possessing firearms when
the court deems it appropriate to do so in order to protect
a victim.

Article XII, Section 1 of New York's Constitution covers both the
"organized" and "unorganized" militia and reads:
The defense and protection of the state and of the United States is an
obligation of all persons within the state. The legislature shall provide for
the discharge of this obligation and for the maintenance and regulation of an
organized militia.
Article 2, Section 4 of the New York Civil Rights Law also reads almost
identical to the Federal 2nd Amendment:
Right to keep and bear arms. A well regulated militia being necessary to the
security of a free state, the right of the people to keep and bear arms cannot be
infringed.
